This definition does not include established human fetal cell lines. The scientific and ethical challenges associated with research utilizing human fetal tissue make it imperative that researchers and their organizations be fully aware of and in compliance with the Federal requirements.
The statute specifically prohibits any person from knowingly acquiring, receiving, or transferring any human fetal tissue for valuable consideration. The term "valuable consideration" is a concept similar to profit and does not include reasonable payment for costs associated with the collection, processing, preservation, storage, quality control, or transportation of these tissues.
Violation of this statute carries criminal penalties that apply to both those that supply and those that acquire human fetal tissue. Current federal laws and regulations require informed consent for research involving the transplantation of human fetal tissue and for research with human fetal material associated with information that can identify a living individual.
Most states require informed consent for the use of fetal tissue in research. Accordingly, NIH expects informed consent to have been obtained from the donor for any NIH-funded research using human fetal tissue. Scientists use fetal tissue as a source of fetal cells. These cells have been used for research since the s, and the government has funded such research since the s, when it was used to create one of the biggest medical advances of the 20th century: the polio vaccine.
Since then, fetal cells have been used in hundreds of thousands of other research projects. Scientists have used them to create other vaccines, such as the rubella vaccine, and to improve a wide variety of techniques used in medicine, such as in vitro fertilization.
They are also used to study birth defects, eye diseases, Parkinson's and Alzheimer's disease, AIDS and spinal cord injuries. Scientists say fetal cells are superior to adult cells mainly because they can transform into any cell in the body. They also replicate quickly, and don't have the same immune response as adult cells. This means researchers can inject them into lab mice to study human diseases without the risk of the cells being rejected by the animals' immune systems.
Adenovirus-based vaccines that cannot replicate when administered to people need to be produced in cells that have the necessary gene to allow for large quantities of the virus to be made.
